The Dublin Airport passenger cap challenge has been referred to the European Court of Justice. The European Union Court will now decide whether the Irish Aviation Authority is entitled to impose certain planning conditions when allocating flight slots.

In his ruling, the High Court’s Mr Justice Barry O’Donnell said that he was satisfied a referral to the CJEU ahead of the full hearing of the issues was appropriate.
