DOT Fines JetBlue $2M for Chronic Flight Delays

The Department of Transportation (DOT) has issued its first-ever penalty for chronic flight delays, fining JetBlue Airways $2 million.

The Department of Transportation (DOT) has issued its first-ever penalty for chronic flight delays, fining JetBlue Airways $2 million.

This groundbreaking enforcement action targets unrealistic scheduling practices that negatively impact passengers and fair market competition. The penalty structure divides the fine equally between the U.S. Treasury and a compensation fund for affected customers.

“When airlines consistently run late flights, they break the law and undermine travelers’ trust,” U.S. Transportation Secretary Pete Buttigieg emphasized.

“This enforcement sends a clear message that airlines must schedule realistically or face consequences. We are committed to protecting passengers and maintaining healthy competition in the aviation sector.”

Patterns of Persistent Delays Revealed


The comprehensive investigation into JetBlue’s operations uncovered concerning patterns of persistent delays. Between June 2022 and November 2023, the airline operated four chronically delayed routes at least 145 times. These four routes experienced consistent delays for five or more consecutive months.

Most notably, the airline had received explicit warnings about delays on its John F. Kennedy International Airport (JFK) to Raleigh-Durham route.

Despite the warnings, JetBlue continued to operate three additional chronically delayed flights connecting Fort Lauderdale with Orlando, JFK, and Windsor Locks.

70% of Disruptions Attributed to Airline

Bureau of Transportation Statistics data reveals the extent of JetBlue’s responsibility, attributing over 70% of these disruptions directly to the airline.

Individual flight delays can stem from various factors, including weather and air traffic control issues. Airlines are required by law to adjust their schedules once patterns of chronic delays become apparent. JetBlue’s failure to make these necessary adjustments led to the unprecedented penalty.

DOT Enforcement Order


The DOT’s enforcement order contains several key provisions designed to address both immediate and future concerns. Beyond requiring JetBlue to immediately cease its pattern of chronic delays, the order mandates a $1 million payment to the U.S. Treasury.

Additionally, the airline must establish a separate $1 million fund dedicated to compensating passengers affected by either the cited delays or any future significant disruptions occurring within the next twelve months. This compensation framework guarantees a minimum payment of $75 per impacted passenger.

Investigation of Other Carriers


The DOT’s enforcement team is actively investigating other carriers for similar scheduling violations, signaling a broader crackdown on industry-wide scheduling practices.

Under federal regulations, flights are classified as “chronically delayed” when they operate at least 10 times monthly and arrive more than 30 minutes late over half the time, including cancellations.

These delays must persist for more than four consecutive months to constitute a violation of scheduling rules.
